1 General
1.1 The general terms and conditions apply to all agreements relating to online orders between Herzog Medical B.V. and the customer.
1.2 The website of Herzog Medical B.V. is regularly updated and/or adapted. Herzog Medical reserves the right to make any changes with immediate effect and without any notice.
1.3 By placing an order, each customer declares, without reservation, to agree with the general terms and conditions of delivery.

3 Offers and offers
3.1 The prices mentioned with the articles are in euros, including VAT. Shipping costs are not included in the prices listed.
3.2 The offer contains a complete and accurate description of the products offered. The description is sufficiently detailed to allow a proper assessment of the offer. If the entrepreneur uses images these are as much as possible a truthful representation of the offered products.
3.3 Herzog Medical B.V. is not liable for the consequences of typesetting, typing and/or programming or program errors in its website. No rights can be derived from unlawful price information.
3.4 The limited period of validity and conditions of special offers, deviating from the usual assortment, are explicitly stated.
3.5 Offers from Herzog Medical B.V. do not automatically apply to repeat orders.
3.6 Herzog Medical B.V. cannot be held to its offer if the customer should have understood that the offer contained an obvious mistake or error.
3.7 Additions, changes and/or verbal promises are only effective if agreed in writing.
4 The agreement
4.1 An agreement between Herzog Medical B.V. and the customer is concluded after an order has been assessed for feasibility by Herzog Medical B.V.
4.2. If the customer has accepted the offer by electronic means, Herzog Medical B.V. immediately confirms the receipt of the acceptance of the offer by electronic means. As long as the receipt of this acceptance has not been confirmed by Herzog Medical B.V., the consumer may terminate the contract.
4.3 Herzog Medical B.V. takes appropriate technical and organizational measures to secure the electronic transfer of data and ensures a secure web environment.
4.4 Herzog Medical B.V. can inform itself – within legal frameworks – whether the customer can meet his payment obligations, as well as all those facts and factors that are important for a responsible conclusion of the distance contract. If, on the basis of this investigation, Herzog Medical B.V. has good grounds not to enter into the agreement, he is entitled to refuse an order or application or to attach special conditions to the execution.
4.5. Herzog Medical B.V. will send the following information to the consumer, in writing or in such a way that it can be stored by the consumer in an accessible manner on a durable data carrier:
a) address and contact details where the customer can go with complaints.
b) the conditions under which and the way in which the customer can make use of the right of withdrawal, or a clear statement regarding the exclusion of the right of withdrawal.

5 Payment
5.1 Payment takes place via the payment methods offered on the website.
5.2 Payment of the order is always made entirely in advance. The order will not be sent until the payment has been paid in full.
6 Shipping costs
6.1 The shipping costs depend on the destination of the order and are clearly displayed on the webshop.
6.2 From a spending of € 60.00, no shipping costs will be charged within the Netherlands and Belgium.
7 Delivery
7.1 Herzog Medical B.V. outsources the home delivery of the orders to recognized postal companies.
7.2 Herzog Medical B.V. strives to send orders within 1 working day after receipt of payment.
7.3 Herzog Medical B.V. has a judicial delivery period of 30 days. If the customer has not received the order within this period, he can cancel the purchase free of charge.
7.4 Herzog Medical B.V. strives to deliver all products from stock. However, an item may be temporarily out of stock or sold out. In this case, the customer will be informed, with the right to cancel the order free of charge. In this case, Herzog Medical will take care of the reimbursement.
7.5 Herzog Medical B.V. is not liable for any damage that the customer may suffer because the order has been delivered to a residential address incorrectly specified by the customer.
7.6 The risk of damage and/or loss of products rests with Herzog Medical B.V. until the moment of delivery to the consumer or a pre-designated representative made known to the entrepreneur, unless expressly agreed otherwise.
8 Cancel/change order
8.1 It is possible to cancel an order if this is done before 13:00 on the day the order was placed and provided that the order has not yet been sent. You can report this cancellation by email or by phone.

9 Exchanges and Returns
9.1 After delivery of the order, the customer has 14 days to exchange or return the items. At the end of this period, the purchase can no longer be dissolved and is final.
9.2 During the cooling-off period, the customer will handle the product and the packaging with care. He will only extract the product to that extent in order to be able to assess whether he wishes to retain the product.
9.3 In order to exercise his right of withdrawal, the customer will comply with the reasonable and clear instructions provided by the entrepreneur upon delivery.
9.4 The following conditions apply to returns and/or exchanges:
a) Does the customer wish to return the goods or has a defect been detected? Please report this to customer service (info@herzogmedical.com)before sending anything back.
b) The goods must be in their original condition, i.e. unworn, returned in the original packaging.
c) You bear the costs of the return shipment yourself. Insufficient or unstamped returns are not accepted by us, regardless of the reason for the return.
9.5 The above rules apply to items purchased through HerzogMedical.com. Items purchased through one of the independent points of sale must be exchanged/returned through the relevant point of sale according to their exchange and return policy.
10 Costs in case of exchange and return
10.1 The postage costs as well as the shipping risk for return shipment are for the customer’s own account.
10.2 When exchanging an article, Herzog Medical B.V. will once bear the shipping costs of the item to be resent.
10.3 When returning 1 or more items, Herzog Medical B.V. will transfer the returned amount (excl. shipping costs) to the customer after the relevant items have been received back. This amount will be transferred to the customer within 30 days at the latest

11 Warranty and complaints procedure
11.1 Herzog Medical B.V. guarantees that the products delivered via its webshop meet the requirements of usability, reliability and lifespan as reasonably intended by the parties to the purchase agreement, and is therefore responsible for the guarantee of the product delivered to you.
11.2 The customer is obliged to check the delivered goods immediately upon receipt. If it turns out that the delivered order is wrong, or incomplete, the customer (before returning to Herzog Medical B.V.) must immediately report these defects in writing to Herzog Medical B.V. by sending an email to info@herzogmedical.com. Any mishandled items must be reported in writing within 1 week of delivery to Herzog Medical B.V. The return of the products must be returned in the original packaging (including accompanying documentation) and in new condition. [See article 8 exchange & returns.]
11.3 Commissioning after detection of defect, damage caused after discovery of defect and / or resale after discovery of defect, this right to complain and return completely lapses.
11.4 As proof of the warranty, the customer will receive a proof of purchase from Herzog Medical B.V.
11.5 Herzog Medical B.V. has a sufficiently publicized complaints procedure and handles the complaint in accordance with this complaints procedure. Namely:
a) It is important that in the event of a defect or warranty on an item purchased from Herzog Medical B.V., the customer contacts the company by sending an email to info@herzogmedical.com
b) This e-mail must contain the order number, a detailed description of the defect and possibly one or more photos of the defect.
c) After receipt of the e-mail, the request will be processed and feedback will be given within 30 days.
11.6 If the customer’s complaint actually falls under the liability of Herzog Medical B.V., the amount of the compensation will at all times be limited to a maximum of the invoice amount of the products concerned.
11.7 In the event of replacement, the item returned by the customer automatically becomes the property of Herzog Medical B.V.
11.8 The aforementioned guarantee does not apply if the defect has arisen as a result of:
(a) careless, improper or injudicious use
b) when the delivered articles have been treated contrary to the instructions of Herzog Medical B.V. and /or instructions for use on the packaging
(c) where the washing instructions have not been followed
d) when the customer has tried to apply changes to the article / the article has been processed by third parties
e) when the delivered goods have been exposed to abnormal circumstances or have otherwise been handled carelessly.
(f) when the life of the product has expired.
11.9 When the product has been purchased via one of the points of sale of Herzog Medical B.V., all warranty and complaints must go through the relevant point of sale.
12 Privacy
Your personal data will be included in the customer database of Herzog Medical B.V. We use your personal data for the execution of the agreement, conducting responsible customer management, risk management and for marketing purposes. We do not provide data to third parties that affect your privacy. If you no longer wish to receive any more commercial offers from us, you can confirm this to us by e-mail.
